1. １ 当該建設業者は、発注者から請け負った泉佐野市内の民間発注の工事（以下「本件工事」という。）において、令和４年12月頃に発注者に特定住宅瑕疵担保責任の履行の確保等に関する法律（平成19年法律第66号。以下「履行確保法」という。）第３条第１項の新築住宅（以下単に「新築住宅」という。）を引き渡した後、同項の規定に違反して、同項の基準日から３週間を経過する日（令和５年４月21日（金））までの間において、同項の規定による住宅建設瑕疵担保保証金の供託又は同条第２項に規定する住宅建設瑕疵担保責任保険契約（以下単に「住宅建設瑕疵担保責任保険契約」という。）の締結をしていなかった。 ２ (1) 当該建設業者は、発注者から請け負って引き渡した岸和田市内の新築住宅を対象として、平成29年10月に住宅建設瑕疵担保責任保険契約の締結をしたものの、履行確保法第４条第１項の規定に違反して、同項の基準日ごとに、その基準日から３週間以内に、当該契約締結の状況について、同項の規定による届出をしなかった。 (2) 当該建設業者は、本件工事において新築住宅を発注者に引き渡したにもかかわらず、履行確保法第４条第１項の規定に違反して、同項の基準日ごとに、その基準日から３週間以内に、当該基準日に係る同法第３条第１項の規定による住宅建設瑕疵担保保証金の供託及び住宅建設瑕疵担保責任保険契約の締結の状況について、同法第４条第１項の規定による届出をしなかった。 ３ 当該建設業者は、２(1)のとおり、履行確保法第４条第１項の規定による届出を同項の基準日ごとにしていなかったため、当該基準日の翌日から起算して50日を経過した日以後においては、新たに住宅を新築する建設工事の請負契約を締結してはならないにもかかわらず、同法第５条の規定に違反して、令和４年10月に、発注者と本件工事の請負契約を締結した。（建設業法第28条第１項第９号該当）
