被処分者は、令和５年６月に締結された定期建物賃貸借契約の媒介業務を行った。 この業務において、①法第３５条に定める書面（重要事項説明書）に記載すべき当該契約に定められた契約解除事項について、当該事項を定めた条項の条番号を記載するに留め、当該条番号において契約解除の内容が明示された契約書の案文を重要事項説明書に添付しなかったことにより、契約解除の具体かつ詳細な内容につき借主の認識・理解を阻害するなど取引の公正を害する業務を行った。②重要事項説明書に記載すべき当該契約に定められた損害賠償額の予定及び違約金に関する事項について、当該事項を定めた条項の条番号を記載するに留め、当該条番号において損害賠償額の予定及び違約金の内容が明示された契約書の案文を重要事項説明書に添付しなかったことにより、損害賠償額の予定及び違約金の具体かつ詳細な内容につき借主の認識・理解を阻害するなど取引の公正を害する業務を行った。 これらのことは、法第６５条第１項第２号に該当する。
