当該建設業者は、大阪市内の民間発注の工事において、株式会社石仲に移動式クレーンの操作等を請け負わせたが、次の(1)から(4)までに掲げるとおり、元請負人として建設工事を適切に施工しなかったため、当該クレーンがバランスを崩して傾き、建設中の鉄骨と鉄骨を吊り上げ作業中のアームが接触してアームが折れ、その吊り上げ中の鉄骨が建設工事現場周辺の家屋等２棟の屋根に落下し、当該屋根が破損するなど、公衆に危害を及ぼした。 (1) 移動式クレーンの転倒等による労働者の危険を防止するため、あらかじめ、当該作業に係る場所の広さ、地形及び地質の状態、運搬しようとする荷の重量等を考慮した作業方法、転倒防止のための方法、労働者の配置及び指揮系統を定めていないこと。 (2) 高さが５メートル以上の建築物の鉄骨の組立て作業を行うときに、あらかじめ、安全な作業の方法を示した作業計画を定めていなかったこと。 (3) 地盤が軟弱であることにより移動式クレーンが転倒するおそれのある場所で、移動式クレーンの転倒を防止するため必要な広さ及び強度を有する鉄板等を敷設せずに移動式クレーンを用いて作業を下請負人に行わせたこと。 (4) つり上げ荷重２５トンの移動式クレーンを操作する者に対し、機械の操作による労働災害を防止するため必要な事項（地番が軟弱であることを考慮し、必要な広さ、強度を有する鉄板等を敷設すること）を通知しなかったこと。
