山政建設株式会社の元取締役は、元請として請け負った東かがわ市帰来地内の工事において、一次下請人の労働者が、作業中コンクリートミキサー車と接触、負傷し、４日以上休業したのに、本工事の監理技術者であり、現場責任者として施工監理及び安全管理を統括していたにも関わらず、一次下請負人等と共謀し、遅滞なく労働者死傷病報告を所轄の東かがわ労働基準監督署長に提出せず、もって法令で定める報告を怠った。 このことから、元取締役は、労働安全衛生法第100条第１項（労働安全衛生規則第97条第１項）違反により、高松簡易裁判所から罰金15万円の判決を受け、令和７年２月１日にその判決が確定している。 これは、建設業法第28条第１項第３号に該当すると認められる。
