株式会社イーストテックは、令和２年度防災・安全交付金施設機能向上（加速化）工事を施工する事業者である。同社の従業員であるＡは、現場責任者として同工事現場における労働者の安全管理を統括していた。令和４年２月28日、長野市松代町東条の工事現場において労働者Ｂに、車両系建設機械であるドラグ・ショベルを用いて、砕石を投入するなどの作業を行わせるに当たり、運転中の前記ドラグ・ショベルに接触することにより労働者に危険が生じるおそれがあったのに、誘導者を配置していなかったにもかかわらず、その運転区域内に労働者が立ち入らないように立入禁止の措置を講じず、労働者Ｃを砕石の締固め作業に立ち入らせ、ドラグ・ショベルのバケットに激突し死亡するという災害が発生した。 このことにより、株式会社イーストテック及び従業員Ａは労働安全衛生法違反により各々罰金20万円、15万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
