On June 28, 2020,株式会社クリケン used fittings incompatible with the cross joints of steel pipes to assemble scaffolding at a building construction site in Hiroshima city, for the purpose of removing a horizontal net installed 15 floors above. As a result, when a worker attempted to climb the scaffold, the fittings at the cross joints slipped sideways, causing the scaffold to fall. The worker fell to death. Subsequently, the company and its employee each received a summary order of fines—30,000 yen and 20,000 yen respectively—for violations of the Industrial Safety and Health Act from Hiroshima Summary Court, with the penalties finalized on August 19, 2021. This incident is deemed to constitute a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act.

株式会社クリケンは，令和２年６月28日に広島市内のビル新築工事現場において，15階上方に設けられた水平ネットの撤去作業のため，鋼管の交差部に適合しない付属金具を使用し，鋼管足場を組み労働者に使用させたものである。その結果，労働者が鋼管足場を上がろうとした際，鋼管足場の交差部の金具が横滑りし鋼管足場が脱落したことで，労働者が墜落し死亡した。 このことにより，同社及び同社の従業員は，広島簡易裁判所から労働安全衛生法違反により，それぞれ罰金30万円及び罰金20万円の略式命令を受け，令和３年８月19日にその刑が確定した。 このことが，建設業法第28条第１項第３号に該当すると認められる。
