当該建設業者は、愛知県内の民間発注工事において、建設業法第15条第２号及び第26条第３項の規定に違反して、同号に規定する同社の営業所における専任の技術者を、専任を要する主任技術者として工事現場に配置した。 また、当該建設業者は、令和元年10月から令和３年３月までの間に請け負った工事現場の職務に従事しながら実質的に営業所の職務にも従事しうる程度には工事現場と営業所が近接していない千葉県、長野県、宮城県、埼玉県及び鹿児島県内の民間発注工事において、建設業法第15条第２号の規定に違反して、同号に規定する同社の営業所における専任の技術者を同法26条第１項に定める主任技術者として工事現場に配置した。このことにより、営業所における専任の技術者が、その営業所に常勤して専らその職務に従事すべきところ、一定期間、専任しているとは認めがたい状態にあった。
