当該建設業者は、その株主及び従業員である者が、当該建設業者の業務に関し、法定除外理由がないのに、令和４年10月22日午前９時55分頃、当該建設業者の敷地内において、廃棄物である木材約8.36キログラムを焼却した。 このことで、廃棄物の処理及び清掃に関する法律（昭和45年法律第137号）違反により、同人は罰金30万円の刑に処せられ、令和５年３月15日にその刑が確定した。
