当該建設業者は、専任の監理技術者又は主任技術者の配置を要する大阪市内、高槻市内、枚方市内、松原市内及び兵庫県神戸市内の民間発注の建設工事において、建設業法第７条第２号及び第26条第３項の規定に違反して、同号に規定する当該建設業者の営業所における専任技術者を、主任技術者として工事現場に配置した。また、当該建設工事において、同項の規定に違反して、これらの工事の互いに重複する期間、同氏を主任技術者として工事現場に配置した。
