丸浜舗道株式会社は、山梨県から請け負った主任技術者を工事現場に専任で置くことが必要な工事である「（主）富士川身延線 舗装補修工事の２（明許）（余フ）」に配置した主任技術者を、甲府市上下水道局から請け負った「（路4-10）路面復旧工事（余フ）」及び「下水道改良工事(公共R5-8)(余フ)」の２件の工事に、工期が重複しているにもかかわらず配置し、施工に当たらせていた。 このことは、建設業法第２６条第３項の規定に違反し、同法第２８条第１項本文に該当すると認められる。
