当該建設業者は、令和３年８月６日に建設業法第28条第３項の規定により建設業に係る営業停止の処分を受け、同月18日から同年10月1日までの間、その営業の全部の停止を命じられていた。よって、当該処分を受ける前に締結された請負契約に係る建設工事に限り施工することができ（同法第29条の３第１項）、当該処分を受けた後に締結された請負契約に係る建設工事を施工することはできなかった。 それにもかかわらず、当該建設業者令和３年８月10日付けで新たに建設工事請負契約を締結するなどして、当該営業停止期間中に施工した。
