平成30年10月11日、東京都目黒区内の工事において、有限会社ナガクボ工業に派遣された労働者が、屋上にある廃棄物の搬出を行うため、鉄製の外部階段を昇降していたところ、同階段の踏み段が外れ、約９メートル下に墜落し、死亡する災害が発生した。同工事における施工管理と安全管理を統括する同社取締役は、さび付いて腐食した鉄製の外部階段を被災者に使用させ、屋上に通じる安全な通路を設けていなかった。 以上のことが、労働安全衛生法第23条及び労働安全衛生規則第540条第１項に違反し、有限会社ナガクボ工業及び同社取締役が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
