株式会社Ｏ．Ｄ．Ａは、令和2年8月18日付けで建設業許可申請を行い、令和2年11月11日に一般建設業の許可を受けた。その後、営業所技術者が主たる営業所で常勤できないこととなったため、新たに営業所技術者を雇用した。しかし、そのことについて建設業法第11条第4項の規定に定める変更届の提出を怠っていた。 このことは、建設業法第7条第1項第2号及び第11条第4項の規定に違反し、同法第28条第1項本文に該当すると認められる。
