(1) 当該建設業者は、大阪市発注の工事において、建設業法第26条第３項の規定に違反して、他の工事現場に専任の主任技術者として配置すべきＡ氏を主任技術者の配置に専任を要する本件工事の工事現場に非専任の主任技術者として配置する（加えて、他社の現場代理人でもあった）など適格な主任技術者を配置せず、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社タケムラに請け負わせた。 (2) 当該建設業者は、経営規模等評価の申請において、建設業法第27条の26第２項から第４項までの規定に違反して、Ａ氏が他社の工事の現場代理人となっていたにもかかわらず、同氏を「技術職員名簿」に記載をした。 これにより得た経営事項審査結果を大阪市等に提出し、大阪市等がその結果を建築一式工事に係る資格審査に用いた。
