岡田建設株式会社は、令和４年７月３０日、千葉県富津市湊での木造家屋の新築工事において、労働者らに同所で軒の高さが５メートル以上の木造建築物の構造部材の組み立て作業を行わせるに当たり同社代表取締役は同作業主任者として同組立作業を直接指揮せず、もって作業主任者に当該作業に従事する労働者の指揮その他厚生労働省令で定める事項を行わせなかった。 また、同所２階床部分で木材の運搬作業を行わせるに当たり、同床には開口部があり、同開口部からの墜落により労働者に危険を及ぼすおそれがあり、同開口部に囲いを設けるなどのその危険を防止するための必要な処置を講じなかった。 当該事実に基づき、木更津簡易裁判所から令和５年６月１日付け令和５年（い）第１０５号略式命令において、労働安全衛生法違反により、同社、同社代表取締役及び同社従業員1名が罰金２０万円に処せられた。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
