八巻板金工業株式会社の役員は、令和３年１１月１８日、秋田県横手市内の個人住宅の雨樋解体工事の現場において、同社が雇用する労働者に対し、墜落による危険を防止するための措置を講じなければならないにもかかわらず、その措置を講じなかったことにより、当該労働者を地面に墜落させ、重傷頭部外傷の傷害を負わせた。 これにより、同社及び同社の役員が、令和５年３月１０日、横手簡易裁判所から労働安全衛生法違反の罪により罰金３０万円の略式命令を受け、同年３月２９日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
