蜂谷工業株式会社は建設業法第２６条の規定に違反して、資格要件を満たさない者を主任技術者及び監理技術者として、２名を８工事現場に配置していた。 また、経営事項審査において、資格要件を満たさない者５０名を複数年にわたり、技術職員名簿に記載し、虚偽の申請を行うことにより得た経営事項審査結果を公共工事の発注者に提出し、公共発注者がその結果を資格審査に用いた。 これらのことが、２８条第１項第２号に該当すると認められる。
