株式会社ベリーズ・インクは令和５年４月13日に東京都町田市内の工事において、労働者に高さ4.25メートルの受水槽の上を作業床として使用させるに当たり、同作業床の端に手すり等を設けることが容易であったのにこれを設けず、労働者が墜落するおそれのある場所に係る危険を防止するために必要な措置を講じなかった。 以上のことが、労働安全衛生法第21条第２項、労働安全衛生規則（昭和47年労働省令第32号）第519条第１項に違反し、令和６年10月31日、株式会社ベリーズ・インクが罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
