ワイエイシイメカトロニクス株式会社は、工事現場の職務に従事しながら実質的に営業所の職務にも従事しうる程度には工事現場と営業所が近接していない熊本県菊池郡内の工事外２件の工事において、建設業法第７条第２号の規定に違反して、同号に規定する営業所における専任の技術者を同法第26条第１項に規定する主任技術者として工事現場に配置した。 このことが、建設業法第28条第１項本文に該当する。
