株式会社大和日昇建設は、同社が請け負った滋賀県彦根市内のマンション新築工事において、同社の労働者が就業中に傷害を負い、４日以上休業したにもかかわらず、遅滞なく労働者死傷病報告書を所轄の彦根労働基準監督署長に提出しなかった。 このことにより同社及びその代表取締役は、労働安全衛生法違反として罰金に処する旨の略式命令を受け、令和７年９月９日に当該命令が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
