A former advisor of Aisawa Kogyo Co., Ltd. (hereinafter "the Company") received guidance on a price close to the investigation standard price, which is a confidential matter of the construction project "Gifu (2) Evaluation Facility New Construction and Other Works" (hereinafter "the Project"), during a general competitive bid conducted by the Kinki Central Defense Bureau of the Ministry of Defense on November 20, 2020. Furthermore, together with the former Nagoya branch manager of the Company and the former Nagoya branch manager of Senkō-gumi, the joint venture partner of Senkō-gumi and Aisawa Kogyo Construction, they conspired and used false pretenses to obstruct fair bidding. As a result, both the former advisor and the former Nagoya branch manager were found to have violated Article 8 of the Act against Unjustifiable Premiums and Misleading Representations (Anti-Cartel Act) and Article 96-6, Paragraph 1 of the Penal Code (Obstruction of Public Contract Competition), and were sentenced to 1 year and 6 months in prison, with a 3-year suspended sentence, on November 7, 2022, with the sentence finalized. This is deemed to fall under Article 28, Paragraph 1, Items 2 and 3 of the Construction Business Act.

アイサワ工業株式会社(以下「同社」という。）元顧問は、令和２年１１月２０日に防衛省近畿中部防衛局が執行した「岐阜（２）評価施設新設建築その他工事」（以下「本件工事」という。）の一般競争入札において、当時防衛省近畿中部防衛局建築課長から本件工事の秘密事項である調査基準価格と近似した価格の教示を受けた。さらに、同社元名古屋支店長及び錢高組・アイサワ工業建設共同企業体の代表企業である株式会社錢高組の元名古屋支店長とともに共謀し共謀し偽計を用いて、公正な入札を妨害したものである。 これにより、同社元顧問及び元名古屋支店長は、入札談合等関与行為の排除及び防止並びに職員による入札等の公正を害すべき行為の処罰に関する法律（官製談合防止法）第８条違反及び刑法第９６条の６第１項（公契約関係競売等妨害罪）違反に該当し、両者は令和４年１１月７日に懲役１年６ヶ月（執行猶予３年）の判決を受け、その刑が確定した。 このことが建設業法第２８条第1項第２号及び第３号に該当すると認められる。
