株式会社斎藤建設の代表取締役は、令和３年３月１６日、秋田県大館市比内町地内の建築工事現場において、同社従業員が脚立からの転落により、左肘頭骨折の傷害を負い、４日以上休業することとなったため、遅滞なく、労働者死病報告書を所轄の大館労働基準監督署長へ提出して報告しなければならないにもかかわらず、令和５年２月２４日に至るまで同報告書を同労働基準監督署長に報告しなかった。 これにより、同社及び同社代表取締役は、令和５年５月２３日、大館簡易裁判所から労働安全衛生法違反の罪により罰金２０万円の略式命令を受け、同年６月８日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
