有限会社長栄塗装工業の役員は、同社の業務に関し、令和５年３月27日、駿東郡長泉町内の看板撤去工事現場において、労働者につり上げ荷重が１トン以上のクレーンの玉掛けの業務を行わせるに当たり、玉掛け技能講習を修了した者その他厚生労働省令で定める資格を有する者でなければ就かせてはならないのに、その資格を有しない貴社の役員自ら玉掛けの業務を行い、もって法令の定める玉掛け資格を有しない労働者をつり上げ荷重が１トン以上のクレーンの玉掛けの業務に就かせた。 この件について、沼津簡易裁判所は令和５年10月25日に貴社の役員に対し、労働安全衛生法違反に基づき罰金30万円の略式命令を行い、これが確定した。 このことは建設業法第28条第１項第３号に該当するものと認められる。
