有限会社長野索道は、機械器具設置工事等の業務を営む事業者である。同社の労働者であるＡは、同社の代表取締役であるＢから選任された、富山県中新川郡上市町伊折六ヶ村入会字ソロメキ１番５の馬場島発電所大規模改修工事のケーブルクレーン解体作業現場における作業指揮者である。Ａは、同社の業務に関し、令和６年６月18日、同作業現場において、ケーブルクレーンの下部鉄塔解体作業を行うにあたり、作業の方法及び労働者の配置を決定し、作業を指揮しなければならないのに、作業の方法及び労働者の配置を決定せず、作業を指揮せずに作業を行わせ、もって機械、器具その他の設備による危険を防止するため必要な措置を講じなかった。 このことにより、有限会社長野索道及びＡは労働安全衛生法等違反により各々罰金30万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
