株式会社石川組の元役員（犯行当時取締役）は鹿角市花輪にて施工された建築工事（建物の解体工事）において、下請業者の労働者が脚立を使用し、ダクトの解体作業をしていたところ、脚立から転落する災害が発生した際、当該下請業者の現場代理人らと共謀し、災害の発生場所等を下請業者の営業所とした内容虚偽の労働者死傷病報告書を大館労働基準監督署に提出した。 これにより、元役員は労働安全衛生法違反の罪により罰金２０万円の略式命令を受け、令和７年６月２４日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
