当該業者の元代表取締役及び元取締役が、一関市が執行した管工事（新一関市立大東中学校校舎増築等（機械設備）工事ほか１件）の制限付一般競争入札に関し、一関市職員（当時）と共謀の上、制限付一般競争入札に関する秘密事項である予定価格の教示を受け、よって同工事の制限付一般競争入札において、同社に入札させて、同工事を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為をしたことにより、盛岡地方裁判所から元代表取締役が懲役10月、執行猶予３年、元取締役が懲役１年、執行猶予３年の判決を受け、その刑が確定している。このことが、建設業法第28条第１項第２号及び第３号に該当すると認められる。
