不動産売買契約において、住宅が接道要件を満たしていないにも関わらず、重要事項説明書に接道要件を満たす旨の記載をし、所属の宅地建物取引士をして記名押印させ交付を行った。このことは法第35条第1項第2号の規定に違反し、法第65条第２項第2号による業務停止７日に該当するが、買主に金銭的損害がないことから、法第65条第1項により指示処分とする。
