株式会社橋本組は、発注者である焼津市から直接請け負った「令和元年度焼津市ターントクルこども館建設工事（債務負担行為）（建築工事）」において、１階鉄筋コンクリートの柱を本来と異なる位置に打設したため、当該打設により生じた位置の差異の補正に際し、公共建築工事標準仕様書（建築工事編）に基づかない塗厚、工法によりモルタルを施工し、供用後に当該モルタルの一部が剥落する事故を生じさせる等、粗雑工事を行った事により、工事目的物に重大な瑕疵を生じさせた。また、当該施工不良を認識していながら、その旨を発注者へ報告せずに隠蔽し、設計図書のとおりに施工したかのような虚偽の施工図等を発注者に提出した。 このことが建設業法第２８条第１項第２号に該当すると認められる。
