当該建設業者は、大阪府が発注者である大阪市内の工事において、その請け負った建設工事を株式会社天雫に請け負わせたにも関わらず、建設業法第24条の８第２項の規定に違反して、当該建設業者が作成した作業員名簿に株式会社天雫の取締役を当該建設業者の従業員である旨の虚偽の記載をして、発注者から直接その工事を請け負った特定建設業者に対し、株式会社天雫と下請契約をした旨の再下請負の通知を行わなかった。
