令和６年１２月２３日、熊本県人吉市中神町の護岸工事現場において、丸昭建設株式会社の現場代理人が操作する重機のバケットと土手の間に労働者が挟まれ、負傷する事故が発生した。 この件に関し、現場代理人が重機を用いて行う作業と、労働者たる被災者が同重機のバケットから生コンをかき出して締め固め、又はならす等の作業を同一場所で行うに当たり、重機のバケットが被災者に接触しないように連絡及び調整する必要があったにもかかわらず、これを行わず、前記各作業が同一の場所で行われることによって生ずる労働災害を防止するための必要な措置が講じられていなかったことにより、同社に対し、人吉簡易裁判所から労働安全衛生法違反として罰金２０万円の略式命令があり、令和７年８月２０日、その刑が確定した。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
