令和３年９月１日に保証協会の社員の地位を失ったことにより、当該地位を失った日から１週間以内に、法第２５条第１項から第３項までの規定により営業保証金を供託しなければならなかったにもかかわらず、これを行わなかった。 このことは、法第６４条の１５（社員の地位を失った場合の営業保証金の供託）前段の違反に当たることから、法第６５条第２項第２号の規定に基づき、令和３年１０月２８日付けで、当該業者に対する処分を業務停止３０日とするとともに、同日付けで業務停止期間が満了する日までに営業保証金を供託するよう勧告したが、その勧告に従わず期日までに供託した旨の届出をしなかった。
