かましんは、遅くとも令和４年３月１日から令和７年１２月７日までの間、自社に継続して商品を納入する事業者に対して、(1) 自社の店舗の新規開店又は改装開店に際し、当該店舗の利益を確保するため、あらかじめ算出根拠等を明確にすることなく、その提供を通じて納入業者が販売促進効果等の利益を得ることができないにもかかわらず、「オープン協賛」と称して、当該店舗の初回に納入する商品について、通常納入価格から半額又は全額を値下げした価格で納入させることにより、当該価格と通常納入価格との差額に相当する経済上の利益を提供させていた。 (2) 自社の店舗の新規開店、改装開店、棚替え又はおせち商品の販売に際し、これらを実施する店舗において、納入業者が納入する商品以外の商品を含む当該店舗の商品の陳列等の作業を行わせるため、あらかじめ当該納入業者との間でその従業員等の派遣の条件について合意することなく、かつ、派遣のために通常必要な費用を自己が負担することなく、自己のために当該納入業者の従業員等を派遣させていた。
