株式会社スカイテックは、一次下請として請け負った群馬県太田市における鉄塔建替工事において、令和４年４月１９日、休業４日以上の労働災害が発生したにもかかわらず、同年８月１０日に至るまで労働者死傷病報告書を所轄労働基準監督署長に提出しなかった。 この件について、遅滞なく法令の定める報告をしなかったとして、同社及び同社の元取締役１名は、令和５年３月３０日付けで労働安全衛生法違反により、太田簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
