当該業者の代表取締役黒澤武男氏は、業務全般を統括管理するとともに、労働者の安全管理を行うものであるが、その業務に関し、令和３年７月31日、労働者に車両系運搬機械等であるクレーンを搭載した貨物自動車を用いて荷の積み込み作業を行うに当たり、あらかじめ、当該作業に係る場所の広さ及び地形等に適応する作業計画を定め、かつ、当該作業計画により作業を行わせなければならないのに、これを定めずに作業を行わせ、もって機械等による危険を防止するために必要な措置を講じなかったことにより、当該業者及び同社が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
