本県発注の長井古座線（仮称八郎山トンネル）道路改良工事において、株式会社堀組を構成員とする特定建設工事共同企業体は、令和４年９月に完成検査を受け工事を完了した。令和４年１２月、同トンネルの照明施設整備工事において、覆工コンクリート内に空洞の存在が判明した。その後、本県が設置した有識者による技術検討委員会の調査等により、粗雑な工事やそれに伴う虚偽報告の事実が発覚した。 このことが建設業法第２８条第１項第２号に該当すると認められる。
