株式会社パセオは、令和６ 年９ 月２ 日に清水町内工事現場において、地上から 約４ メートル掘削した溝の中で、労働者２ 名に配管の設置作業を行わせるに当た り、土止め支保工を設ける等の地山の崩壊を防止するための措置を講じなかった ため、法面の土砂が崩壊して両者生き埋めになり、１ 名が死亡、外１ 名が負傷 した。 このことにより、労働安全衛生法第２ １ 条第２ 項及び労働安全衛生規則第534条 第１ 号違反により、帯広簡易裁判所において同社が罰金刑に処せられ、令和７ 年 ８ 月２ ６ 日にその刑が確定した。 このことは、建設業法第２ ８ 条第１ 項第３ 号に該当するものである。
