株式会社中村建設は、東京都内の公共工事において、建設業法第22条第１項の規定に違反して、自らが請け負った建設工事を一括して下請業者に請け負わせた。また、建設業法第26条第２項の規定に違反して、当該工事現場に監理技術者を配置しなかった。さらに、事実と異なる下請内容を記載した虚偽の施工体制台帳及び施工体系図を作成した。 このことが、建設業法第28条第３項に該当する。
