株式会社兵藤工務店は、令和４年１１月１５日に同社赤城加工場において、無資格の従業員がフォークリフトを運転して貨物自動車から重量約500kgの木材の積荷の荷下ろしを行った際、積荷が落下し、運転手が積荷の下敷きになり死亡する事故を発生させた。 このことにより、株式会社兵藤工務店他１名は、前橋労働基準監督署から労働安全衛生法第61条第２項、労働安全衛生法施行令第20条第11号及び労働安全衛生規則第41条違反により送検されて前橋簡易裁判所において罰金刑の判決を受け、令和５年７月１３日に同判決が確定した。 このことは、建設業法第２８条第１項第３号に該当するものであり、同条同項に基づき指示処分とするもの。
