塚元海事（有）は、令和５年１月２０日、長崎市内の公共工事の現場内において、雇用する労働者が作業中に転倒して顔面挫滅創、頭部打撲傷などの傷害を負うなど加療約１ヶ月を要する休業４日以上の労働災害に関し、当該労働災害が別の場所で発生したとする虚偽の内容を労働基準監督署に届け出たもの。 このことで、塚元海事（有）及び専務取締役 塚元 安弘が労働安全衛生法違反により、それぞれ罰金20万円の略式命令を受け、令和６年６月８日にその刑が確定した。このことが、建設業法第２８条第１項第３号に該当し、監督処分の対象となる。
