吉田直土木株式会社が一次下請として請け負った北海道二海郡八雲町におけるトンネル工事において、令和４年２月１５日、同社の作業員１名が後進してきたトラクター・ショベルに轢かれて負傷する事故が発生した。 この件について、機械等による危険を防止するため必要な措置を講じなかったとして、同社及び同社の社員１名は、令和５年３月２４日付けで労働安全衛生法違反により、八雲簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
