村上建設工業株式会社の取締役は，同社が入場していた石巻市鮎川浜南地内の工事現場で，令和3年2月23日，同社の作業員が地上から約3.5m突出していたマンホール最上部から降りる際に使用した脚立が折れて墜落して負傷し休業4日以上を要したのに，同市築山四丁目に所在する同社の資材置場で負傷した旨の虚偽の内容を記載した労働者死傷病報告書を同年3月3日に提出した。 このことにより，令和3年12月9日に石巻簡易裁判所から，同社取締役は労働安全衛生法（昭和47年法律第57号）違反により罰金刑の略式命令を受け，その刑が確定した。 このことは，建設業法第28条第1項第3号に該当する。
