当該建設業者は、発注者から請け負ったマンションの改装工事（内装工事及び外壁塗装工事）（工事場所：福岡県）（以下「本件工事」という。）において、建設業法第26条第1項の規定に違反して、工事現場に主任技術者を配置しなかった。 当該建設業者は、本件工事において、建設業法第３条第1項の規定に違反して同項の許可を受けないで建設業を営む者（以下「本件無許可業者」という。）と下請契約を締結した。 当該建設業者は、本件工事において、その請け負った建設工事の主たる部分を本件無許可業者に請け負わせた。また、上述のとおり、主任技術者を配置せず、建設業法第３条第１項の許可を受けていない者と下請契約を締結するほか、安全対策が講じられることなく畳等の廃棄物が５階等から投げ降ろされていた。 このように、当該建設業者と直接的かつ恒常的な雇用関係を有する適格な主任技術者が配置されず、主任技術者による現場作業に係る実施の総括的技術指導、施工に必要な許可の確認などの法令順守の確認、安全確保のための作業場所の巡視などが十分に行われておらず、当該建設業者は、本件工事において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して本件無許可業者に請け負わせた。
