令和３年６月２３日、ミスタータイヤマン西津田外壁塗装工事現場において、同工事の塗装作業を請け負う有限会社矢野塗装の労働者が足場から墜落する労働災害が発生したにもかかわらず、同社代表取締役である矢野賢二は令和３年７月１６日、「自社倉庫の修理の際に労働災害が発生した」とする虚偽の内容の労働者死傷病報告を松江労働基準監督署長に提出したものである。 このことについて、労働安全衛生法違反の罪により、同社及び同社代表取締役が、松江簡易裁判所よりそれぞれ罰金刑の判決を受け、令和４年９月２日にその刑が確定した。このことが、建設業法第２８条第１項第３号に該当すると認められる。
