谷永工業代表者の谷永圭次は、足場の解体作業中に、危険を防止するための必要な措置を講じなかったことにより、労働安全衛生法（昭和47年法律第57号）第20条第１号及び労働安全衛生規則（昭和47年労働省令第32号）第552条第１項第４号、並びに刑法（明治40年法律第45号）第221条前段に違反したとして、労働安全衛生法違反及び業務上過失致死の事実により、令和６年12月25日、富山簡易裁判所から罰金50万円の略式命令を受け、令和７年１月15日、その刑が確定した。 このことが、建設業法第28条第１項第３号に該当するため
