（有）川下工務店は、泉大津市内の民間発注工事において、建設業法第3条第1項の規定に違反して解体工事業に係る同項の許可を受けないで請負代金が建設業法施行令第1条の2に定める金額以上となる建設工事を請け負った建設業者から請け負った。また、当該工事を建設業法第3条第1項に違反して許可を受けないで営業する者と請負代金の額が建設業法施行令第1条の2に定める金額以上となる下請契約を締結した。 このことは、それぞれ建設業法第28条第1項第6号の規定に該当すると認められる。
