上記の建設業者は他の事業者らと共同して、特定エレベーター方式ＰＳ設置工事について、平成３０年７月１日以降、供給価格の低落防止等を図るため、供給予定者を決定し、供給予定者が供給できるようにすることにより、公共の利益に反して、工事の取引分野における競争を実質的に制限していた。これが私的独占の禁止及び公正取引の確保に関する法律（昭和２２年法律第５４号）第３条に違反するものと認定され、公正取引委員会から排除措置命令を受けた。 このことが、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
