当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、建設業法第３条第１項の規定に違反して建具工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を株式会社BUDDYから請け負った。 また、当該建設業者は、本件工事において、下請負人に対する現場作業に係る実地の技術指導、元請負人との協議、下請負人からの協議事項への判断・対応などを主として行わないなど自ら施工計画の作成、工程管理、品質管理、安全管理、技術的指導等を主として行わず請け負った建具工事の主たる部分を有限会社オーケーエンジニアリングに請け負わせており、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して同社に請け負わせた。
