森元工業株式会社の機材センターにおいて、労働者に対し、くい打機のリーダーに油圧モーターを取り付ける等の組立作業を行うに当たり、作業の方法、手順等を定め、これらを労働者に周知させ、かつ、作業を指揮するものを指名して、その直接の指揮の下に作業を行わせなければならないにもかかわらず、これを行わなかった。その結果、貴社及び貴社の社員が横浜簡易裁判所から労働安全衛生法違反で罰金刑の略式命令を受け、令和４年10月25日にその刑が確定した。このことは建設業法第28条第１項第３号に該当する。
