当該建設業者の元専務取締役（当時）は、一関市が発注した水道施設工事及び管工事（市道幸町市役所前線他配水管布設工事ほか７件）の制限付一般競争入札及び指名競争入札に関して、一関市職員（当時）から、予定価格の教示を受け、同予定価格に近接する金額で落札した。さらに、設計金額の教示を受けるという有利かつ便宜な計らいを受けたいという趣旨及び教示を受けたこと等に対する謝礼の趣旨の下、一関市職員（当時）に対して飲食接待等を供与し、賄賂を供与したことにより、盛岡地方裁判所から懲役２年、執行猶予４年の判決を受け、その刑が確定している。 このことが、建設業法第28条第１項第２号及び第３号に該当すると認められる。
