谷川工業株式会社は，広島市水道局と令和３年２月に契約締結した山田第一ポンプ所ほか新築その他工事において，営業所の専任技術者を専任が必要な監理技術者として配置し，現場に常駐させた。 そのため，当該技術者は営業所に常勤して専らその職務に従事すべきところ，専任しているとは認め難い状態にあった。 このことは，建設業法第７条第２号に違反し，同法第２８条第１項本文に該当すると認められる。
